Horse trading is a threat to democracy, says Justice Ijaz-ul-Ahsan

ISLAMABAD (92 News) – Horse trading is a threat to democracy and system, Justice Ijaz-ul-Ahsan remarked on the issue of interpretation of Article 63.

A five-member larger bench headed by Chief Justice Omar Ata Bandial heard the presidential reference. Imran Khan’s lawyer Babar Awan took a stand that if the term is not fixed then the disqualification will be for life. The disqualification will continue until the court removes the disqualification declaration.

Justice Mazhar Alam Mian Khel while talking to Babar Awan said that Article 63G should also be read, violation of which is a more serious crime which is related to ridicule of judiciary and army and ideology of Pakistan.

Justice Muneeb Akhtar asked how Article 63A relates to Article 62 One F? On which Babar Awan said that Article 63A itself disqualifies a deviant member for life. After the completion of Babar Awan’s arguments, PML-Q lawyer Azhar Siddique started.

Justice Jamal Khan Mandokhel inquired whether an independent member of the Assembly would take an oath before joining the party that he would abide by every decision of the party. Lawyer Azhar Siddique said that the independent member accepts all the conditions before joining the party. According to PML-Q lawyer, dissident members cannot vote. Article 63A is a protective wall against the no-confidence motion.

Justice Ejaz-ul-Haq remarked that it has become a tradition to overthrow the government with money, this process should be stopped now. The court adjourned the hearing for one day. Azhar Siddique will continue his arguments tomorrow.
