Blue Cross Blue Shield has recently completed the settlement process with its subscribers and is now in the stages of assessing claims and sending out notifications regarding claim decisions to those who have submitted their claims. The Blue Cross Blue Shield Association consists of 33 independent, local BCBSA companies across the US, providing health insurance to over 115 million individuals. This settlement addresses the claims that Blue Cross Blue Shield breached antitrust laws.
Health Coverage for a Third of Americans from Blue Cross Blue Shield
As a prominent healthcare provider in the United States, Blue Cross Blue Shield delivers health insurance to one out of every three Americans as of 2023, through its network of 33 independent entities. The companies under the Blue Cross Blue Shield umbrella are community-based and manage their operations locally. Furthermore, they stand as one of the nation’s largest employers, with a workforce of over 150,000 across the country.
Healthcare coverage remains a critical issue in the United States. Current data from 2023 shows that slightly more than 92% of Americans have some form of health insurance, with private companies providing 65.4% of this coverage. By 2025, Blue Cross Blue Shield plans to expand its network agreements to include 1.7 million physicians and hospitals nationwide, further distributing $600 billion in health coverage claims.
Blue Cross Blue Shield Reaches a $2.67 Billion Settlement in Antitrust Case
In 2013, Blue Cross Blue Shield was hit with a class-action lawsuit accusing them of violating antitrust laws. After a protracted seven-year legal struggle, an agreement was reached in October 2020. According to the official settlement website, the agreement includes a $2.67 billion settlement fund and commitments from Blue Cross Blue Shield to alter its business practices to foster more competition in the health insurance marketplace.
“The plaintiffs claimed that the settling defendants had breached antitrust laws by agreeing amongst themselves not to compete and to restrict competition in the sale of health insurance and administrative services. The settling defendants have denied all wrongdoing, claiming their actions result in lower healthcare costs and increased access to healthcare for their customers. The court has not determined who is right or wrong. Instead, the parties have settled to avoid the risks and costs of continued litigation,” states the Blue Cross Blue Shield settlement website.
Despite denying these claims, Blue Cross Blue Shield has not yet declared when it will begin disbursing payments. Approximately six million individuals have filed claims, potentially resulting in individual payments of about $300. The deadline to challenge or withdraw from the settlement passed in May 2022.
Another Settlement on the Horizon for Blue Cross Blue Shield
Beyond the 2020 settlement, Blue Cross Blue Shield has agreed to a second class-action settlement with hospitals and healthcare providers, amounting to $2.8 billion. This lawsuit, initiated in 2012, accuses Blue Cross Blue Shield of inflating insurance costs and reducing reimbursements. Once again, Blue Cross Blue Shield has denied any wrongdoing regarding this settlement.
Opponents of the settlement still have an opportunity to file objections before the court finalizes its decision. A final fairness hearing is scheduled for July 16, 2025. However, in a twist of events, on March 5, several hospital systems and healthcare providers initiated separate lawsuits in federal courts in California, Illinois, and Pennsylvania. They accuse Blue Cross Blue Shield and its affiliates of massive underpayments, opting out of the $2.8 billion class action settlement to pursue independent legal action.
